
Public Notice | Development Regulations Amendment No. 17, 2025
The general public is invited to view a draft copy of the Town of Torbay Development Regulations Amendment No. 17, 2025, which is proposing text amendments to the Torbay Development Regulations 2015-2025 as follows. To amend:
1.Schedule A (Definitions) to distinguish between secondary suite (currently subsidiary apartment) and in-law suite,
2.Schedule B (Classification Table) to ensure secondary suite and in-law suite are listed as examples for the single dwelling class,
3.Schedule C for the RMD, RI, RLL, RSL, MIX, TC and CMS Land Use Zone Tables to add secondary suite and in-law suite to the list of permitted uses and specify conditions, and
4.Schedule D (Off-street Parking Requirements) to exchange the term subsidiary apartment with secondary suite and in-law suite.
The proposed text amendment will amend the term “subsidiary apartment” to be titled “secondary suite” in the Development Regulations and associated Schedules.
The purpose of the amendment is to accelerate the permitting of “missing middle” dwelling units, so the Town can consider secondary suites and in-law suites as permitted uses within single dwellings in all residential land use zones, as well as within existing single dwellings within the Mixed Development (MIX), Town Centre (TC) Zone and Commercial Main Street (CM) Zones. The public may provide any comments or concerns on the proposed change to the Town in writing before Council proceeds with adopting the proposed amendment. The Town of Torbay Draft Development Regulations Amendment No. 17, 2025, and associated background documents shall be on display at Torbay Town Hall, 1288 Torbay Road, as of March 18, 2025 during regular business hours. The deadline for written comments HAS BEEN EXTENDED TO 4:00 pm, Thursday, April 17, 2025.
